Probate is the process where our last affairs are addressed and handled in our absence.  While clearly it is a meeting we will not be present for, it is extremely important that we plan well in advance of this day to get our affairs in order to ensure our wishes are followed regarding the handling and distribution of our assets.


Just as important in the preplanning is a need to ensure that our assets are passed to our loved ones and  associates with the least impact from taxes and fees.  This is where we can help you set up trusts, add dependents to existing accounts, and take the steps required to reduce or eliminate the taxes that will be assessed on property we leave behind for others.

 

Probate is the process of filing and validating a will in the court system. It includes paying the debts and taxes of the deceased individual, whether that is based on the information provided in the will or according to the law of South Carolina. A person, usually a surviving spouse or an adult child, is appointed by the court if there is no Will, or nominated by the deceased person's Will. Once appointed, this person, called an executor or Personal Representative, has the legal authority to gather and value the assets owned by the estate, to pay bills, and to distribute the assets to the heirs or beneficiaries.
